As a result of these uncertain times, some sellers may be choosing to cancel their listings for the time being, leaving an opening for other agents to use the common prospecting tactic of calling canceled listings to try and re-list them. However, just because a listing has been canceled does not necessarily mean that their listing agreement with their original agent is also canceled.
Before you contact a homeowner about a previously listed property, check Agent Remarks to see if any notes have been left about future plans or ongoing representation agreements. Remember, soliciting sellers under an active agency representation agreement is a violation of Article 16 of the REALTOR® Code of Ethics:
REALTORS® shall not engage in any practice or take any action inconsistent with exclusive representation or exclusive brokerage relationship agreements that other REALTORS® have with clients.
